Humans are born with immense sense of creativity bringing new ideas to life that can paint the world anew. Intellectual property law protects the human endeavors of creativity in order to stimulate further inventiveness. Intellectual Property law is not a single homogeneous body of law, generally thought to comprise four different but overlapping fields of law. i.e Trademarks, copyrights, patents, trade secrets. Traditional IPRs have evolved significantly with the passage of time, expanding to cover complex areas like confidential information, protections for technological advancements in electronics and innovation in design, Geographical indications etc. With the advent of technology some forms of intellectual property such as domain names and moving images shown on acompany’s webpage, have come into existence recently that underscores the dynamism in intellectual property related to digital assets. With the exponential growth of information through the easily accessible internet, the field of Intellectual Property is confronted with multitude of challenges.Within a few hours after the world premiere of latest movies, counterfeit copies are usually available on the streets of world-class cities for miniscule amounts of monies and are freely accessible on the website BitTorrent for free downloading. Although people have realized the need for protection of IPRs, the rapidly developing pace of technology has led to increased awareness of the importance of intellectual property assets. The illegal activities like piracy, counterfeiting and other forms of IP infringement, not only undermines the human endeavours but also divert the revenue from established enterprises that hinders investment in creative endeavours. In a market economy the most valuable assets a company owns are its intellectual property assets, in the form of patents protecting the innovations, trademarks shielding their brand image, copyright and designs securing the artistic character of their work.
This maiden edition of the Intellectual Property and Innovation Review reiterates its commitment to in form the readers the nuances of intellectual property as our world becomes increasingly reliant on technological advancements, greater demands and challenges are made on Intellectual property practitioners and enthusiasts. In an effort to expand the reach to a wider audience, this volume includes wide range of themes reflecting contemporary areas of interest like in-depth analysis of geographical indications in Himachal Pradesh and Assam, accompanied by a detailed book review. The Volume also reconnoitres the intersection of artificial intelligence and creativity, enquiring into how and what challenges it might pose in the present world order. The crucial and emerging field of digital health, the development of digital libraries, and critical discussions on fair use, have also been incorporated in the volume. Succinctly, put together, these issues offer a rich tapestry of valuable insights into the not-so-embryonic landscape of intellectual property, technology, and law.
I extend my heartfelt gratitude to the contributors who have dedicatedly worked upon advancing the boundaries of different aspects of Intellectual property through their insightful and contemplative take on emerging issues of IPRs. Their unwavering commitment to come up with thought provoking ideas will certainly add academic value to this maiden publication.
